La Teoría Sistémica del Derecho, como pensamiento alternativo es un programa transformador de la realidad. Por ello, enfrenta al Futuro como tarea, el Presente como responsabilidad y el conocer el Pasado como necesidad. Más el pasado a conocer es el pasado de los vencidos. Propone utilizar la memoria como herramienta para discernir la situación de hoy. Reconociendo que los olvidados de hoy, son los pobres. En América Latina, tal es el punto, de donde debemos partir en nuestros análisis. Por oposición a la Modernidad nacida en 1492, la Teoría Sistémica del Derecho vá en búsqueda de un universo jurídico más complejo y abierto que el tradicional, en una práctica en el que los excluídos son reconocidos en la dignidad de su persona. Mirando al Otro, como ser trascendente, como lo que no podemos colocar como mediación de nuestro proyecto, sino como ser digno que tiene sus intereses a los que debemos servir. El saber jurídico, debe emplearse como un saber liberador, así el concepto de liberación adquiere actualidad

The Systemic Theory of the Right, as alternative thought is a program transformer of the reality. For it, it faces to the Future as task, the Present like responsibility and knowing the Past as necessity. Plus the past to know is the past of the conquered ones. He/she intends to use the memory like tool to discern today's situation. Recognizing that those forgotten of today, they are the poor. In Latin America, such it is the point, of where we should leave in our analyses. For opposition to the Modernity born in 1492, the Systemic Theory of the Right vá in search of a more complex and more open juridical universe that the traditional one, in a practice in which the excluídos is recognized in their person's dignity. Looking to the Other one, as being transcendent, as what we cannot place as mediation of our project, but as being worthy that he/she has their interests to those that we should serve. The juridical knowledge, it should be used as a to know liberador, the liberation concept acquires this way present time.
